Insegurança jurídica pode afugentar investimentos minerais no Pará

Segundo o Ibram, com medo de novas ocupações, mineradoras devem preferir a África. A invasão do MST aos trilhos da Estrada de Ferro Carajás (PA) reavivou a insegurança jurídica, que poderá inibir ou até transferir para a África os investimentos futuros das principais mineradoras em atividade no estado. A previsão é de Paulo Camilo Penna, presidente do Instituto Brasileiro de Mineração (Ibram) – entidade que congrega as principais companhias mineradoras do País (Companhia Siderúrgica Nacional, Vale do Rio Doce, Cimento Tupi, Caemi Mineração e Metalurgia, Camargo Correa Cimentos, entre outras). Penna reclama da insegurança jurídica provocada nos últimos anos por uma série de ações governamentais no Pará, considerado uma das maiores províncias minerais do mundo. `No ambiente de negócios existe uma tremenda instabilidade política, institucional e jurídica de toda a sorte, que não oferece segurança para investimento no estado`, enfatizou o presidente do Ibram. A ferrovia, operada pela Companhia Vale do Rio Doce, foi invadida na última terça-feira em um trecho no município de Parauapebas, região Leste e a 836 km da capital Belém. Os trens voltaram a circular pela estrada, com restrições, no fim da tarde de quinta-feira. O tráfego havia sido interrompido na quarta-feira pela manhã. O secretário estadual de Desenvolvimento, Ciência e Tecnologia, Maurílio Monteiro, que também é o coordenador do doutorado de Desenvolvimento Regional na Universidade Federal do Pará, disse que as afirmações de Camilo Penna `carecem de uma base empírica`. `A possibilidade dos investimentos migrarem para a África são especulações. Temos elementos concretos, com base em levantamentos recentes, que em termos de perspectiva de investimentos o Brasil está muito à frente de qualquer país africano`, disse o secretário do governo petista de Julia Carepa. Ainda de acordo Maurílio Monteiro, o Brasil é hoje a segunda melhor opção de investimento no mundo em termos de mineração. `Isso se soma ao fato de que na Amazônia, na área de influência da Sudam (Superintendência de Desenvolvimento da Amazônia) os investidores podem contar com uma redução na alíquota de imposto de renda da ordem de 75%, um incentivo a mais para atrair investimentos`, completa o secretário do governo paraense. Já no entender do presidente do Ibram, três situações corroboram a insegurança jurídica para investimentos: a atuação do MST, a criação das chamadas unidades de conservação e a imposição de uma espécie de taxa ambiental. `Tive a oportunidade de estar com o secretário Maurílio Monteiro no último dia 18 e disse que, com os preços que as comodities estão é muito provável que o estado não deixe de ter investimentos em projetos pela importância que a região tem nas jazidas minerais. Mas disse também que não há dúvida de que os projetos na África terão um peso potencial muito maior para as companhias, o que vai nos fazer perder muitos projetos para países africanos`, reclamou. Para o secretário do governo paraense, nos países africanos com jazidas minerais de interesse das companhias `as pessoas conseguem ter mais previsibilidade e segurança do que no Brasil`. No episódio da invasão do MST à linha férrea, Camilo Penna reclamou ao secretário de Desenvolvimento do Pará sobre a forma de intervenção das autoridades estaduais no caso. `Nós não sentimos um desejo expresso em ações de reverter aquela situação do MST`, lembrou o presidente do Ibram. O governo do Pará, temendo uma tragédia semelhante à que aconteceu em Eldorado dos Carajás em 1998, quando 19 sem terra foram mortos a tiros por uma tropa da polícia militar, criou uma política diferenciada de tratar com a questão fundiária. Maurílio Monteiro defendeu a atuação do governo no episódio. `Em hipótese alguma vamos permitir no estado que se repita tragédia como aquela que foi o massacre de Eldorado dos Carajás`, disse. `A governadora tem determinado que os conflitos sejam solucionados através da mediação e da negociação. A ferrovia foi desocupada, cumprindo uma ordem judicial, a partir da negociação e assim vai continuar sendo. Faremos negociações com todos os entes econômicos, sejam eles ambientalistas ou sem terra, todos vão continuar tendo o respeito do governo e tendo como mecanismo de solução a mediação`, afirmou o secretário. Para ele, essa política parece estar sendo positiva. `Tanto é que, deste ano até 2009, apenas no âmbito da mineração nós teremos investimentos na ordem de R$ 9,8 bilhões e achamos que a sinalização das empresas é de que esses investimentos continuem nesse ritmo`, acrescentou Maurílio Monteiro. Na mediação de desocupação dos trilhos da ferrovia, segundo nota divulgada pela Secretaria de Segurança paraense, ficou estabelecido que o governo do Pará receberá uma comissão do MST nesta quarta-feira e que, no dia seguinte, os sem-terra serão recebidos na secretaria-geral da Presidência da República, em Brasília. `Diante das negociações, o MST, após a desobstrução da ferrovia, fez o recuo para a área de segurança limite da ferrovia (área lateral, a mais de 40 metros) e também retiraram os bloqueios da via`, diz um trecho da nota divulgada pela Secretaria de Segurança paraense. Na operação de desobstrução estiveram envolvidos dois delegados, 25 agentes da Polícia Federal, 10 policiais civis e 80 policiais militares. `O cumprimento formal do mandado foi totalmente de forma pacífica. Não houve violência, resistência, apreensão ou prisão, segundo declarou o oficial de justiça`, finaliza a nota. O MST, embora tenha concordado em desobstruir os trilhos e se afastar do leito da ferrovia, afirmou que não abrirá mão de suas reivindicações. `A ocupação dos trilhos, a paralisação das atividades de tráfego de minério da CVRD (Companhia Vale do Rio Doce) é a forma de responsabilizar o governo federal, o governo estadual e a própria CVRD pela incapacidade de resolver o problema agrário, mineral e ambiental que vivem os trabalhadores do campo e das cidades`, afirmou Charles Trocate, da direção do MST no Pará.
